हाम्रा मागहरुमा ‘हक’ र ‘हित’सम्बन्धी विषयवस्तु छुट्टिने गरेका छैनन्, तिनीहरु गञ्जागोल नै छन् । न्यूनतम ज्याला निर्धारणपछि जहिले पनि विवाद र बहस किन हुन्छ ? त्यसको एउटा कारण हो, युनियनहरु ज्याला निर्धारणको कामलाई तलबमा भएको वृद्धि संझिन्छन् र सबैतिर सोही अनुपातमा बढ्नुपर्ने अडान राख्छन् । तर रोजगारदाताहरु यसलाई न्यूनतम अङ्कको ‘पुनरावलोकन’ मात्रै ठान्छन् । यो समस्या हल गर्न ज्याला पुनरावलोकन लगत्तै सामूहिक सौदाबाजी गरिनु पथ्र्यो । आधार अङ्क केन्द्रले सुधारेपछि प्रतिष्ठानको ल्याकतकै आधारमा सबै श्रमिकको तलब/सुविधाको पुनरावलोकन प्रतिष्ठान तहबाट टुङ्ग्याइनु पथ्र्यो । आधार अङ्क केन्द्रले सुधारेपछि प्रतिष्ठानको ल्याकतकै आधारमा सबै श्रमिकको तलब/सुविधाको पुनरावलोकन प्रतिष्ठान तहबाट टुङ्ग्याइनु पथ्र्यो ।  तर, हाम्रा संरचनाहरु एक–अर्कालाई दोषारोपण गरी ‘पानीमाथि ओभाना हुने’ एउटा अमिल्दो चक्रमा ˚सिरहेको देखिन्छ । स्थानीय तहको समस्यामा संलग्न हुने अधिकार कानुनले दिएको छैन भन्दै महासंघहरु टकटकिने, केन्द्रीय संघहरु पनि सोही नजीर तेस्र्याएर साखुल्ले पल्टने र स्थानीय तह ‘सकेसम्म आफ्नो व्यवस्थापनसँग नराम्रो हुन नपरोस्’को मनस्थितिमा माथितिर तेस्र्याएर उम्किन खोज्ने गरेको देखिन्छ ।  केन्द्रदेखि स्थानीय तहसम्मै कतिपय हाम्रा युनियन संरचनाहरुमा, आएको झमेला तत्काल सल्ट्याउँ र श्रमिकको मन जितौँ भन्ने हैन कि समस्यालाई पर–पर सार्ने र अन्ततः त्यसलाई टार्ने व्यवहार प्रतिबिम्बित हुने गरेको छ । अझ यस्तो आचरणलाई संक्रमणकालीन राजनीतिसँग जोडेर उम्कने गरिन्छ ।

Wage Negotiation: Misleading Rumours and the Reality

March 24, 2011 was a historical day for the trade unions in Nepal. The National Trade Union Centres- GEFONT ANTUF and NTUCI have made the agreement with the Employers’ Organisations (FNCCI & CNI) for the wage increment of the workers; as per the Labour Law-2048, the minimum wage of the workers will review in every two years. This has been the highest increment in the wage of the workers and the agreement doesn’t incorporate any negative aspects. The agreement also ensured the Social Protection to all irregular workers which were one of the demands since the establishment of multi-party democratic system. But, the fact has been diverted and some ‘elements’ are active in creating many illusions in our World of Work.

Flexibility is the glamorous word for business community, IFIs, Government and the planners now days.   One of the agenda of the flexibility is employer right to hire & fire. It demands that market should have right to determine value of our labour; whether or not to provide employment, standard wage and benefits etc. Thus the challenge of the day is liberalisation vs. workers protection. Capital demands laissez-faire governance of the market, whereas trade unions are struggling hard to introduce & continue labour inspection in order to maintain minimum labour standard at least.

The Role of Trade Union in Nepal in the 21st Century

Nepali trade union movement has not yet organised the vast majority of agricultural workers and there are no clear legal provisions for them. Since the economy is agro-based, unorganised agricultural labourers have to be brought under the umbrella of the trade union movement also for the commercialization of agriculture. The issue of minimum wage is as important as the unionization of agricultural workers. However, there are numerous complications in the determination of minimum wages due to non-monetisation in rural areas and kind payment practices. Along with the fixation of minimum wages, steps have to be taken for the protection of health conditions, for the adjustment of workers to technological changes in agriculture and for the increases in skill and productivity.

Trade Union Movement in Nepal: A Brief History

“Your Highness! The workers have been led by some so-called leaders in the employment of my different factories and are staying in the quarters in the Mills compounds. They have organised large processions of the workers and have invited leaders and other agitators from socialists unions from British India.” Sixth day after launching Nepal’s first ever labour movement on March 10, 1947, General Manager of Jute Mills R. K. Sihaniya wrote an appeal to control movement. Mr. Sihaniya named 5 persons as the leaders of the agitation, two of them Man Mohan Adhikari and G. P. Koirala.
